Defenders of the Constitution are the Enemies of the State

On 1 March 07, I was scheduled to fly on American Airlines to Newark, NJ, to attend an academic conference at Princeton University, designed to focus on my latest scholarly book, Constitutional Democracy, published by Johns Hopkins University Press this past Thanksgiving.

When I tried to use the curb-side check in at the Sunport, I was denied a boarding pass because I was on the Terrorist Watch list. I was instructed to go inside and talk to a clerk. At this point, I should note that I am not only the McCormick Professor of Jurisprudence (emeritus) but also a retired Marine colonel. I fought in the Korean War as a young lieutenant, was wounded, and decorated for heroism. I remained a professional soldier for more than five years and then accepted a commission as a reserve office, serving for an additional 19 years.

I presented my credentials from the Marine Corps to a very polite clerk for American Airlines. One of the two people to whom I talked asked a question and offered a frightening comment: “Have you been in any peace marches? We ban a lot of people from flying because of that.” I explained that I had not so marched but had, in September, 2006, given a lecture at Princeton, televised and put on the Web, highly critical of George Bush for his many violations of the Constitution. “That’ll do it,” the man said.

After carefully examining my credentials, the clerk asked if he could take them to TSA officials. I agreed. He returned about ten minutes later and said I could have a boarding pass, but added: “I must warn you, they=re going to ransack your luggage.” On my return flight, I had no problem with obtaining a boarding pass, but my luggage was “lost.” Airlines do lose a lot of luggage and this “loss” could have been a mere coincidence. In light of previous events, however, I’m a tad skeptical.

I confess to having been furious that any American citizen would be singled out for governmental harassment because he or she criticized any elected official, Democrat or Republican. That harassment is, in and of itself, a flagrant violation not only of the First Amendment but also of our entire scheme of constitutional government. This effort to punish a critic states my lecture’s argument far more eloquently and forcefully than I ever could. Further, that an administration headed by two men who had “had other priorities” than to risk their own lives when their turn to fight for their country came up, should brand as a threat to the United States a person who did not run away but stood up and fought for his country and was wounded in battle, goes beyond the outrageous. …

I have a personal stake here, but so do all Americans who take their political system seriously. Thus I hope you and your colleagues will take some positive action to bring the Administration’s conduct to the attention of a far larger, and more influential, audience than I could hope to reach.

Which is more worrying, a former Marine being banned from flying, or the fact that Barack Obama, that brave shining light of the opposition, is being hailed and lauded by the architects of President Bush’s disastrous foreign policy? (Of course, the fact that Senator Obama is a major contender for the presidential candidacy of one of the two major parties in the country makes us quite suspicious of him as it is. Steve Sailer has pointed out even deeper reasons.)

    Indeed, the veracity of Prof. Murphy’s conclusions is uncertain. However, you are right that Obama is being hailed by the architects of the President’s disastrous foreign policy — a fact that should be troubling to his supporters.

    Dear J.R.,

    May I offer you a few perspectives to strengthen your position and your resolve in the fight for Liberty. Please consider sharing this with all that you can, since an informed citizenry may be our best defense.

    Patriotism is not blind subservience to government, nor loyalty to a particular leader or party. Patriotism is vigilance in protecting and preserving the US Constitution from all who would pervert or overthrow it, or in any way diminish our many rights, liberties, or sovereignties; and, is a willingness to pay a price for our freedom.

    The US Constitution is an inspired document, brilliantly designed to keep the people free and in control of government. It is the Supreme Law of the Land, alive in its safeguards and sound principles. However, enemies of the Constitution would say it is dead or antiquated, suggesting need of replacement or correction; Or, say that it is alive but flawed, suggesting that it can be reshaped into something contrary to its original intent. NOTE: Everything the Constitution stands for is under attack, and most Americans are unaware. We are like the sleeping Gulliver who, if awakened in time, could free himself of the chords that are slowly binding him.

    Abraham Lincoln: “America will never be destroyed from outside. If we falter or lose our freedoms, it will be because we destroyed ourselves.” Is that happening to us?

    Our laws have been manipulated over the past century, deliberately changing us from a Constitutional Republic to an anti-Constitution democracy. Historically, all democracies self-destruct and are replaced with an oligarchy, or the rule on an elite. The purpose of these distortions has been to: Override, ignore, subvert, circumvent, or suspend the US Constitution; Violate the Founder’s intent; Remove their Safeguards; Legalize and promote principles of Socialism, Marxism, Communism and Secular Humanism; Promote fiscal irresponsibility with horrendous spending, entitlement programs, and bailouts; Usurp power and advance tyranny; Destroy the balance of powers; Allow traitors to operate above or outside the law; Eliminate the principles of freedom, independence, and sovereignty; Eliminate the control of the people over government; Ignore, distort, chip away at, or infringe upon the God-given and unalienable rights of the people; Disarm the people; Implement a militarized police-state through Martial Law; Create an national economic collapse; Shift a growing and insurmountable national debt directly onto the backs of each citizen; and Bring each citizen into full submission as a slave to a tyrannical global elite. It is no wonder that our Founders detested democracies the most.

    Attacks upon the Constitution, having gone unimpeded for over 100 years, implies that we cannot look to the federal government for self-correction. Paraphrasing President Ronald Reagan, “We cannot look to the government to solve the problem … government is the problem”. It wants the advancement of tyranny and the loss of our rights. What we have is exactly what they want us to have, or they could have prevented or corrected it.

    There is hope! As a safeguard, and as the most imperative responsibility, our Founders implemented Military Oaths and Oaths of Office to preserve, protect, support and defend the US Constitution against all its enemies, foreign or domestic. Who qualifies as its enemy? NOTE: The only entities which can threaten the Constitution are those who have access to it … its guardians in the three branches of government. Even foreign enemies and influential puppeteers behind the scenes are helpless in threatening our Constitution or diminishing our freedoms without the cooperation of false guardians or traitors within our own government. Every Oath is therefore an implied warning aimed expressly at government leaders to honor their Oaths or be prosecuted as an enemy. From this perspective we can create the following definition:

    Domestic Enemies of the Constitution are its guardians in government (regardless of status or position, past or present) whose manipulation of the law threatens the function, scope, application or impact of the Constitution or in any way violates the Founders’ intent for it; who fail to preserve, protect, honor or defend it; who aid and abet its enemies or interfere with efforts to investigate and prosecute them; or, who resist restoring our Constitutional Republic, and who thereby constitute the greatest threat to the Constitution, to Liberty, and to every American.

    Implication of the Oath: “I will come to understand the Founders’ intent and the US Constitution. I will scrutinize every government action for the slightest threat, and trace it to its originators. Any law, etc.,that prevents me from honoring my Oath is a direct threat to the Constitution, and its originators are likewise an enemy. With my help and vigilance (and without any reservation or evasion on my part), all domestic enemies of the Constitution will be exposed, aggressively investigated, successfully prosecuted, and permanently defeated, and their impact upon the Constitution reversed, so help me God.” ~ Plenty of incriminating evidence exists, so whether by senate hearings, impeachment proceedings, or military tribunals, the purging of hundreds of domestic enemies must be done to restore our Constitutional Republic.

    Treasonous guardians will claim immunity; but that is mere manipulation since their new anti-Constitution laws are not somehow superior to the Supreme Law of the Land. Regardless of high or lofty positions, no one, especially enemies of the Constitution, can ever be above the law or exempt from investigation.

    President John F. Kennedy: “Today we need a nation of minute men; citizens who are not only prepared to take up arms, but citizens who regard the preservation of freedom as a basic purpose of their daily life and who are willing to consciously work and sacrifice for that freedom. The cause of liberty, the cause of America, cannot succeed with any lesser effort.”

    America, and all the hope she stands for, will not survive much longer if enemies of the Constitution are allowed to take full control of government. To tolerate these attacks or ignore our worst enemies allows the destructive course to continue at our own peril.

    Let every citizen be warned, and let our public outcry not be silenced until every domestic enemy is defeated. Let this struggle for liberty be won peaceably during this generation, to avoid bloodshed or slavery for our descendants in the next.
